EmberType Terms of Service

Agreement to These Terms

By downloading, installing, or using EmberType, you agree to these Terms of Service. If you don't agree, please don't use the software.

These terms constitute a legal agreement between you and EmberType ("we", "us", "our").

EmberType License Grant

When you purchase EmberType, we grant you a non-exclusive, non-transferable license to use the software under the following conditions:

• Personal use — You may use EmberType for personal or professional work
• Device limit — You may install and activate EmberType on up to 3 Macs that you own or control
• No sharing — Your license key is for your use only and may not be shared, sold, or transferred to others
• No redistribution — You may not redistribute the pre-built application (however, you may build from source under GPL v3)

Open Source License Notice

EmberType's source code is licensed under the GNU General Public License v3 (GPL v3). This means:

• You may view, modify, and build the source code yourself
• You may distribute your own builds under the same GPL v3 license
• The pre-built application sold through our website is a convenience offering

When you purchase EmberType, you're paying for the convenience of a ready-to-use application, automatic updates, and customer support — not for the source code itself.

Free Trial Period Details

EmberType offers a 7-day free trial with full functionality. Download EmberType to start your trial. During the trial:

• All features are available without restriction
• No payment information is required
• After 7 days, you must purchase a license to continue using the app

Refund and Return Policy

How to Request a Refund

1. Email contact@embertype.com with your purchase email
2. Include "Refund Request" in the subject line
3. We'll process your refund within 5-7 business days

After a Refund

Once refunded, your license key will be deactivated. You may continue using the free trial features until the trial expires, or build from source under GPL v3.

Exceptions

We reserve the right to decline refund requests that appear fraudulent or abusive (e.g., repeated purchases and refunds, or refund requests significantly after the 14-day period).

Payment Processing Details

Payments are processed by Polar.sh, a third-party payment processor. By making a purchase, you also agree to Polar.sh's terms of service. We do not store your payment information. For details, see our Privacy Policy.

Software Updates Policy

Your license includes access to all future updates at no additional cost. Updates are delivered automatically through the app. We reserve the right to:

• Add, modify, or remove features
• Change system requirements for new versions
• End support for older macOS versions

Prohibited Uses of EmberType

You may not:

• Share, sell, or transfer your license key to others
• Use EmberType to violate any laws or regulations
• Reverse engineer the license protection system
• Use automated systems to generate or validate license keys
• Misrepresent your affiliation with EmberType

Disclaimer of Warranties

EmberType is provided "as is" without warranty of any kind. We do not guarantee that:

• The software will meet your specific requirements
• Transcription will be 100% accurate
• The software will be error-free or uninterrupted
• Any errors will be corrected

Speech recognition accuracy depends on many factors including audio quality, accent, background noise, and the AI model used. See our troubleshooting guide for tips on improving accuracy.

Limitation of Liability

To the maximum extent permitted by law, EmberType shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or data
• Business interruption
• Errors in transcription

Our total liability shall not exceed the amount you paid for the software.

Termination of License

We may terminate your license if you violate these terms. Upon termination:

• Your license key will be deactivated
• You must stop using the software
• You may still build from source under GPL v3

Changes to These Terms

We may update these terms from time to time. We'll post changes on this page with an updated date. Continued use of EmberType after changes constitutes acceptance of the new terms.

For significant changes, we may notify you via email or through the app.

Governing Law and Jurisdiction

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the United States.
